הלכות נחלות פרק י · 5 Questions
Question 1
Three brothers divided their father's estate. Afterwards, a creditor comes and expropriates one brother's entire portion. What happens?
When a creditor expropriates part of a divided estate, the division is nullified. The remaining property is re-divided equally among all brothers who had shares.
Question 2
When brothers divide an estate, whose clothing is evaluated as part of the estate?
The brothers' own weekday clothing is evaluated and included. Weekday clothing bought for wives and children is considered already acquired by them (not evaluated). But Sabbath and holiday clothing for wives and children is evaluated.
Question 3
A court divides an estate among orphans — some adults, some minors. The court makes a mistake and gives the minors 15% less than their fair share. Can they contest when they grow up?
A court-supervised division is generally final once the minors come of age. However, if the court erred by a sixth or more (a significant legal threshold for overreaching), they may contest and a new division is made.
Question 4
A father on his deathbed appoints his wife as guardian of their minor children. Can she serve?
The rule that the court does not appoint women as guardians applies only to court appointments. A father has authority over his own estate and may appoint a woman (or minor or servant) as guardian.
Question 5
A guardian appointed by the court is seen living lavishly and spending far beyond his known means. What should the court do?
When a court-appointed guardian lives beyond his means, the court may suspect he is using orphans' funds and should remove him immediately, appointing someone else. (If he was appointed by the father, the bar for removal is higher.)
