Question 1
A buyer purchases three trees in a triangular arrangement with 6 cubits between each tree. Does he acquire the land between them?
Buying three trees in proper triangular formation ('like the three feet of a cooking range') with 4–16 cubits between each tree grants the buyer the land beneath, between, and around them.
Question 2
A buyer purchases two trees in a field. One of the trees dies. What are his rights?
A buyer of two trees acquires no land rights. If a tree dies or is cut down, the buyer loses all connection to that space and has no further claim.
Question 3
Reuven sells a field to Shimon but retains two trees for himself. What land rights does Reuven retain?
The Rambam rules that retaining two or more trees means retaining the land appropriate for them. For trees retained while selling the whole field, the seller retains half the total land — otherwise the buyer could demand he uproot the trees.
Question 4
A seller says 'I am selling you the field except for the trees' when the field has both vines and date palms. What does he retain?
The rule is that sellers sell generously. When there are multiple types of trees, the seller retains the more valuable ones — vines are retained over date palms, and fruit trees over vines.
Question 5
A person sells his grave plot to a buyer. Years later, a family member dies and relatives want to bury him there. What is the halacha?
Family members may bury in a sold grave plot to prevent family disgrace (pegam mishpacha). They must compensate the buyer for the grave actually used, even without the buyer's consent.
